Purchases in K+31

All Requests for Quotations from the Customer are not tenders, bids, auctions or public competitions within the meaning of Articles 447-449, 1057-1061 of the Civil Code of the Russian Federation, and are not regulated by Federal Law No. 223-FZ of 18.07.2011 "On the Purchase of Goods, Works, and Services by Certain Types of Legal Entities" and Federal Law No. 44-FZ of 05.04.2013 "On the Contract System in the Sphere of Purchase of Goods, Works, and Services to Meet State and Municipal Needs".

For the avoidance of doubt, all Requests for Quotations of the Customer shall mean a procedure carried out using the Bidzaar Service, aimed at searching for and identifying a Supplier (Contractor, Performer) of goods and/or works and/or services for the right to further negotiate for the purpose of concluding an agreement. At the same time, the search for and identification of a Supplier (Contractor, Performer), including recognition of such Supplier (Contractor, Performer) as the winner of the Request in accordance with the terms of the User Agreement published on the website of the Copyright Holder, Bidzaar LLC https://bidzaar.com/, does not impose obligations on the Customer to conclude an agreement and is not another legally binding offer to conclude an agreement. The Customer has the right not to conclude an agreement with the Supplier (Contractor, Executor) as a result of the Customer's Request for Price Proposals (to refuse to conclude an agreement unilaterally and out of court) without giving reasons.

The Customer notifies, and the Supplier (Contractor, Performer) acknowledges and agrees that the failure to conclude an agreement between the Customer and the Supplier (Contractor, Performer) following the Customer's Request for Quotations shall not be recognized as the Customer's evasion of concluding an agreement and shall not be grounds for the Customer to compensate the Supplier (Contractor, Performer) for any direct or indirect losses, including expenses for the Supplier (Contractor, Performer) to pay the Copyright Holder's remuneration and/or expenses incurred by the Supplier (Contractor, Performer) in connection with participation in the Customer's Request for Quotations and further negotiations (if applicable) on concluding an agreement.

These terms and conditions for conducting the Customer's Request for Price Proposals apply both to Requests organized by the Customer independently using the functionality of the Bidzaar Service, and to Requests, the organization of which is entrusted by the Customer to the Copyright Holder. By participating in the Customer's Request for Price Proposals, including by submitting an Application, the Supplier (Contractor, Executor) confirms that he has read and fully agrees with these terms and conditions for conducting the Customer's Request for Price Proposals. The contact details of the person responsible for purchasing for each procedure become available after registration on the electronic platform.
